By downloading, installing, or using the W8Log application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

W8Log reserves the right to modify these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

W8Log is an AI-powered workout tracking application that allows users to log workouts using natural language through voice or text input. The App processes this input to extract and organize workout data, and provides visualization and tracking of fitness progress.

3. User Accounts

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and current.

4. User Content

The App allows you to input and store workout data and related information ("User Content"). You retain all rights to your User Content, but you grant W8Log a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving the App.

You are solely responsible for your User Content and the consequences of posting or publishing it. W8Log does not endorse any User Content or any opinion, recommendation, or advice expressed therein.

5. Acceptable Use

You agree not to use the App to:

Violate any applicable laws or regulations
Infringe the rights of any third party
Transmit any material that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity
Interfere with or disrupt the App or servers or networks connected to the App
Attempt to gain unauthorized access to any portion of the App

6. Intellectual Property

The App and its original content, features, and functionality are owned by W8Log and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Premium Subscription

The App offers a Premium subscription that provides access to additional features. By purchasing a Premium subscription, you agree to the following:

Payment will be charged to your account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage your subscriptions and turn off auto-renewal by going to your account settings
No refund is provided for the unused portion of any term

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

W8Log does not warrant that the App will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL W8LOG BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP.

10. Health Disclaimer

The App is not intended to provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

11. Termination

W8Log may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

W8Log reserves the right, at its sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
